A Brookfield man faces up to 10 years in prison for felony OWI after being arrested in the town of Brookfield following a traffic crash.
Peter Pagonis, 68, of the city of Brookfield was charged Wednesday in Waukesha County Circuit Court with his 6th OWI offense.
Pagonis is the husband of Elmbrook School Board member Linda Boucher.
According to the criminal complaint, Pagonis was involved in an accident shortly before 11 p.m. Tuesday, Jan. 24 after allegedly driving on the wrong side of the road in the area of Barker Road and Larkspur Drive.
Police officers noted that they could smell the odor of intoxicants upon meeting with Pagonis and he told them that he had had one beer prior to driving.
Due to his previous OWI offenses, Pagonis was subject to a 0.02 blood alcohol content restriction. A preliminary breath test revealed his blood alcohol content to be 0.147.
According to the complaint, police then confronted Pagonis about his claim of having had only one beer at which time he admitted to having consumed “two or three beers and a shot of whiskey.”
Boucher listed Pagonis as her spouse while seeking election last March and according to information provided by Boucher and the criminal complaint, the two share an address.
Boucher declined to comment when reached Thursday evening.
Pagonis has been ordered to maintain absolute sobriety and not to possess any alcohol, drugs or controlled substances without a valid prescription. He has also been ordered not to operate a motor vehicle unless properly licensed and to report and comply with Wisconsin Community Services Intoxicated Driver Program.
Pagonis is next scheduled to appear in court Feb. 1.
